Terms and Conditions of Hire for Property Rental

  1. Contract for Hire: all bookings are accepted by the Sian and David Richardson and are subject to these conditions which are deemed to be accepted in full by the hirer and all persons in the party as documented on the booking form.
  2. Confirmation: the booking is only confirmed on receipt of the deposit as per clause 3 of these conditions.
  3. Payment: the booking must be accompanied by a deposit of 25% of the total cost. The balance must be paid as per agreement with Javea Holiday Rental or on arrival in cash. If the final payment is not received before receipt of the keys, the owners will regard the hirer to be in breach of contract and have cancelled the booking with the penalties described under 6 below.
  4. What is included: The apartment/villa rental includes: a full inventory of appliances, equipment, utensils and facilities for the stated number of people (see apartment description on website for details); the cost of water and reasonable amount electricity (if air conditioning is used to excess there will be an additional charge); the cost of maintenance of swimming pools and garden; bedding and towels (not beach); normal post rental cleaning (see also 8 below). Please note, no items should be removed from the apartment; in particular towels should not be taken to the beach.
  5. What is not included: Travel or other transportation; airport transfers; personal or medical insurance; beach towels.
  6. Cancellation by hirer: All cancellations of bookings must be made in writing and notified to – and received by – the owners at least 12 weeks prior to the commencement of the hire period. If cancellation is notified as above more than 12 weeks before the commencement of the hire period, the deposit (25% of the total) will be forfeit. Cancellations received later than 12 weeks before the commencement of hire, the full hire cost will be due unless the apartment/villa can be re-let, in which case a goodwill refund will be considered – the amount of such goodwill refund will be at the absolute discretion of the owners.
  7. Occupation: Only persons listed on the booking form can occupy the apartment/villa. The apartment cannot be sub-let to anyone else under any circumstances.
  8. Damage to the apartment/villa or its contents: other than in the case of fair wear and tear, the hirer will be responsible for making good any damage to the apartment/villa or its contents occurring as a result of negligence, accidental damage, wilful damage, or irresponsible behaviour on the part of anyone occupying the apartment or their guests. Such damage should be reported without delay to the local representative. The cost of repairs and/or replacements must be agreed with and paid to the owners or their local representative. A figure of 200 - 250€ (depending on property) will be held as a deposit against such damages subsequently discovered when the apartment/villa is checked following each rental or to cover excessive cleaning costs. The cost of keys mislaid or lost will be deducted from the damage deposit and charged as follows: 1. Apartment front door key 15€, Security barrier key 25€ and all other keys: 3€ each. Deductions made from the damage deposit under any of the above circumstances will be itemised when the balance of the damage deposit is returned.
  9. Hirer’s responsibilities: The hirer is responsible for taking all reasonable care of the apartment/villa, its fabric and contents. The apartment/villa and all furniture, equipment, utensils etc must be left clean and tidy and in their original positions at the end of the hire period. The hirer undertakes to ensure that no member of their party or guests engages in any activity around or in the swimming pool that could cause pollution to the water or damage to the structure or filtration system of the pool. The hirer will also ensure the BBQ (if provided) is cleaned and that all rubbish is put in the communal bins sited in the surrounding area. The hirer will ensure that all members of their party and any guests temporarily accompanying them will abide by the rules of the community in whichever complex booked – particularly in terms of use of the pool during pool opening hours only. The hirer will also ensure that all members of their party and any temporary guests will respect the rights and privacy of other residents of the complex booked – in particular with respect to noisy or anti-social behaviour which could have a detrimental effect on the enjoyment of others residents in the complex. The hirer will also ensure that noise is progressively reduced after 11.00 pm and ceases after 12.00 midnight. This does not mean that quiet conversation, music, television etc cannot continue after midnight, just that it must be at a reasonable enough level so as not to unduly impact the desire of other residents for quiet.
  10. Rights of Access: The owners or their local representative have the right of access to the apartment/villa at any time with due regard to the convenience of the hirer for the purpose of inspection and maintenance.
  11. Responsibilities: Neither the owners or their local agent can be held responsible for any circumstances beyond their control, including (but not limited to) mechanical breakdown; failure of any public service supply howsoever caused; illness of, or accident to, any of the persons named on the booking form or any third party, howsoever caused. The hirer responsible for the booking of the apartment undertakes that no person will suffer anything to be done which would compromise or endanger the owner’s property insurances in respect of the property and its contents which might render the property insurances void or voidable.
  12. Injury and Damage: Neither the owners, nor their local agent will be held liable for any personal injury or the loss or damage of any personal effects of any member of the hirer’s party or their guests, howsoever such injury, loss or damage may have been caused.
  13. Maximum Number of Persons: under no circumstances may the apartment be occupied by more than the stated occupancy (guests of the hirer or his/her party temporarily in the apartment are excluded, provided they do not stay overnight) unless by prior agreement with Javea Holiday Rental. The owners or their local agent reserve the right to exclude the hirer and the hirer’s party from the apartment/villa if this clause is breached.
  14. Information: All information supplied by the owners or their local agent is supplied in good faith and is based on information available at the time. All reasonable care has been taken to ensure the accuracy of any information supplied, but the owners and their local agent are not liable for any variation or inaccuracy, howsoever caused.
  15. Occupancy: The apartment will be available for occupation from 16.00 on the day of arrival and must be vacated by 10.00 on the day of departure. Requests to vary this will be considered sympathetically by the owners. Please see early check-in details on booking form.
  16. Keys: Detailed instructions for key collection, contact details for the owner’s local agent and directions to the apartment/villa will be sent well before the arrival date.
  17. Complaints: Any complaints about the property or its contents must be made in writing immediately to the owners or their local representative, who will take all reasonable steps to remedy the problem, provided it is a reasonable and fair complaint having regard to all the circumstances. Neither the owners nor their local agent shall have any liability for any complaint whatsoever which is submitted after the hire period. The owners and their local agent are not liable for any delays caused by third party personnel or companies (e.g. plumbers, electricians, television service and supply etc).
  18. Insurance: The apartment rental does not include any personal, medical, travel or any other insurance covering the hirer or any member of the hirer’s party.
  19. Termination: hirers will be notified verbally of any failure on their part to conform to these Terms and Conditions. If the non-conformance continues, the hirer will be informed in writing that the hire will be terminated without further notice if the non conformance continues. If the hire is so terminated, the hirer will not be reimbursed any balance of hire remaining and will also forfeit their damage deposit.

It is very strongly recommended that all members of the hirer’s party take out travel insurance covering personal accident, medical treatment and cancellation or curtailment.
